HC rule for law to constitute election commission

Staff Correspondent: The High Court has issued a rule asking the authorities concerned to explain why they should not be directed to formulate a law under Article 118 of the Constitution for constituting the Election Commission.

 

The HC bench of Justice Moyeenul Islam Choudhury and Justice JBM Hassan issued the rule on Monday.

 

The chief election commissioner, cabinet secretary, law secretary and parliament secretary have been made respondents to the rule. They have been asked to give explanation in four weeks.

 

The HC came up with the rule following a writ petition filed by Supreme Court lawyer Eunus Ali Akond seeking necessary order on the authorities to formulate a law under the constitution for appointing the chief election commissioner and other election commissioners.

 

He filed the petition on January 11 seeking the directive of High Court saying that the government is supposed to formulate a law for constituting the Election Commission under Article 118 of the Constitution, but the government is yet to take any initiative in this matter.

 

However, the High Court did not give any order on another writ petition filed by the same lawyer with the High Court challenging the legality of the committee formed to recommend names for the next Election Commission members.
