NSC not allowed interfering in BCB's authority: SC

Staff Correspondent: The Supreme Court (SC) has disposed an appeal petition filed against an High Court (HC) order that declared the amendment to the constitution of the Bangladesh Cricket Board (BCB) as illegal.

A three-member Appellate Division bench headed by the Chief Justice Surendra Kumar Sinha passed the order on Wednesday.

On January 27, 2013, the HC bench of Justice Sarah Mahbub and Justice Abdur Rab declared the amendment to the constitution of BCB illegal, saying the National Sports Council (NSC) has no authority to amend the constitution.

On January 28, 2013, the Chamber bench of the Appellate Division stayed the HC order following a petition filed by NSC.

The stay order later had been extended for several times.

It may be mentioned that Mobasher Hossain, the architect and former BCB director, and Yousuf Jamil Babu, president of the Bangladesh District and Divisional Sports Organisers' Association, filed a writ petition challenging the legality of BCB constitution amended in November 2012.

According to the writ, the constitution was sent to the National Sports Council (NSC) with the views of the councillors taking at the special general meeting of BCB. NSC also returned the constitution to BCB after scrutinizing it. But, NSC again amended the constitution with suggestions of BCB top officials.

Following the writ petition, the court issued rule on December 13, 2012. The court later declared the amendment illegal after the final hearing over the rule.
