Pollen murder case to run in lower court

Staff Correspondent: The Supreme Court (SC) has upheld a High Court (HC) order that cleared the way for a lower court to resume the trial proceedings in cadet college student Sharmila Shaharin Pollen murder case.

A four-member Appellate Division bench of SC headed by the Chief Justice Surendra Kumar Sinha passed the order on Monday morning after rejecting the petitions filed by accused in the case.

Additional Attorney General Murad Reza and Khandoker Mahbub Hossain moved for the deceased Pollen while Barrister Rokon Uddin Mahmud stood for the accused in the court.

Earlier on April 6, the HC bench of Justice Farah Mahbub and Justice Mahmudul Hoque rejected a petition jointly filed by five accused for scrapping the trial proceedings of the case.

The court also lifted its earlier order that stayed the trial proceedings of the case.

Sharmila Shaharin Pollen, 18, a second-year student and daughter of retired Air Force officer Abul Bashar Patwary of Chandpur, was found dead in the bathroom of her dormitory “Shanti House” of the college on February 11, 2005.

The victim’s father lodged a case with the Cognisance Court No-1 on February 19, 2005.

The accused are: the then adjutant Maj Nazmul Haque, the college's associate professor Abul Hossain, the then sergeant Nawsher-uz-Zaman, the then security guard Hena Begum, and the then deputy adjutant general Maj Monir Ahmed Chowdhury of the Army Headquarters.

Of them, four are on bail while Maj Monir remains absconding.
