Verdict on Nizam Hazari’s JS membership Mar 1

Staff Correspondent: The High Court (HC) has fixed March 1 for delivering its verdict, disposing the rule issued on the legality of holding the post of lawmaker by Nizam Uddin Hazari, Awami League MP of Feni-2.

The bench of Justice Md Abu Zafar Siddiqi came up with the order after hearing over the rule on Tuesday.

Barrister Shafique Ahmed and Nurul Islam Sujon moved for Nizam Hazari while Kamrul Islam and Satya Ranjan Mondal stood for the petition in the court.

Earlier, the case was enlisted in the cause list of the single bench of Justice Md Abu Zafar Siddiqi on February 6. Later, hearing was held on it.

Lawyer Satya Ranjan Mondal said the court fixed March 1 for its verdict after hearing was completed on Tuesday.

The High Court delivered split verdict on the writ petition that challenged the legality of Nizam Hazari’s parliament membership.

Senior judge of the High Court bench, Justice Md Emdadul Huq, declared Hazari’s parliament membership illegal after accepting the writ petition.

But the junior judge of the HC bench, Justice FRM Nazmul Ahasan, rejected the petition which implies that he declared the Jatiya Sangsad membership legal.

Later, the bench sent the writ petition along with the split verdict to the table of the chief justice.

The chief justice constituted a single HC bench for the writ’s disposal.

Later, several single benches of HC felt embarrassed in the case.

Shakhawat Hossain Bhuiyan, a Jubo League leader of Feni, filed the petition with the HC on June 8, 2014 praying to the court to declare Nizam, an AL lawmaker of Feni-2 constituency, disqualified for contesting in the parliamentary polls and holding the office as a lawmaker for his alleged forgery in getting early release from jail in a criminal case.
