The Election Commission (EC) will take a constitutional decision on the issue of BNP leader Mohammad Ishraque Hossain's oath as mayor of Dhaka South City Corporation (DSCC), said the Appellate Division.
A seven-member bench of the Appellate Division headed by Chief Justice Dr Syed Refaat Ahmed passed the order on Thursday (May 29).
The court issued this order after hearing the Election Commission's speech on gazette issuance.
Barrister Mahbub Uddin Khokon moved for the Ishraque while Advocate Mohammad Hossain stood for the writ petitioner.
On May 26 this year, Md Mamunur Rashid, who had earlier moved a writ petition before the HC against the tribunal's judgment and the EC's decision, filed the leave to appeal petition with the Appellate Division.
Earlier on May 22, the HC summarily rejected Mamunur's writ petition, which had sought a stay on the lower court judgment and the EC's decision.
