HC rejects stay plea on Tarique-Mamun case



Dhaka, Jan 17 (risingbd24.com)–-The High Court on Thursday turned down a petition seeking a stay on the proceedings of money laundering case filed against BNP leader Tarique Rahman and his business partner Giasuddin Al Mamun.

A third bench of the High Court of Justice M Enayetur Rahim rejected the petition filed by Mamun challenging the legality of the proceedings of the case.

On Oct 26, 2009, ACC Assistant Director Mohammad Ibrahim filed the case with the city’s Ibrahimpur Police Station under the Money Laundering Act-2009.

On August 30, 2012, the counsel for Tarique and Mamun had filed a petition with the lower court seeking staying on the proceedings, but the court rejected the petition on October 18. Later, they filed a criminal review petition with the HC against the lower court order.

On November 27, the HC passed a spilt order following the petition filed by Tarique and Mamun through their lawyers.

Senior Justice Abdul Awal issued a rule upon the government and the Anti Corruption Commission (ACC) as to why conducting the proceedings of the case without taking the government’s permission should not be declared illegal. But junior Justice M Faruk turned down the petition.

Later, the matter was sent to the Chief Justice and he sent the petition along with the split order to the bench of Justice M Enayetur Rahim.

Barrister Moudud Ahmed, Barrister Mahbubuddin Khokon and Barrister Ehsanur Rahman stood for Tarique and Mamun today.

Barrister Ehsanur Rahman said they will appeal against the order.

According to the case statement, Mamun took 7.50 lakh US dollars for Tarique from the chairman of a construction firm for helping the company  get a work order for the construction of 80-MW power plant at Tongi in Gazipur.

The money was transacted in Singapore and it later went into Mamun’s account.
