Bangladeshi avoids deportation in France on air pollution ground

A Bangladesh national has avoided deportation from France on the ground of air pollution in his native country.

A France court ruled that pollution in his native country would aggravate his condition and potentially kill him. 

The Bangladeshi mentioned in his petition that he was suffering from asthma. Although its medicines are available in Bangladesh, the ancillary treatment is inadequate. The level of air pollution in Bangladesh could lead to further deterioration of his health. When the court did not grant his application, he appealed to the Appellate Division of the Bordeaux Administrative Court.

Later, the Court of Appeal of Bordeaux ruled last month that the 40-year-old asthmatic would face ‘a worsening of his respiratory pathology due to air pollution’ if he was deported to Bangladesh.

Ludovic Rivière, the Bangladeshi’s lawyer, said this was the first time a French court had considered environmental criteria to grant state benefits to a foreigner due to illness. Because it is clear that due to the environmental conditions in Bangladesh, it will be impossible to treat my client there, it will push him to death.
